Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FitVents.com (the “Site”), including any purchases of products offered through the Site. The Site is owned and operated by FitVents Inc. (Canada) (“FitVents,” “we,” “us,” or “our”).

By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and our Privacy Policy, Return Policy, and FAQ (together, the “Policies”). If you do not agree, do not use the Site.

2) Eligibility & Use of the Site

You must be the age of majority where you live (or have permission from a parent/guardian) to make purchases on the Site.

You agree not to:

  • use the Site for unlawful purposes

  • attempt to gain unauthorized access to the Site or systems

  • interfere with the Site’s operation (including through bots, scraping, or attacks)

  • misuse promotions, discount codes, chargebacks, or return policies

We may refuse service, cancel orders, or restrict access where permitted by law, including for suspected fraud, abuse, or policy violations.

3) Accounts (If Applicable)

If you create an account, you are responsible for:

  • maintaining the confidentiality of your login information

  • all activity under your account

  • keeping your information accurate and up to date

4) Products, Content & Accuracy

We aim to display product descriptions, images, pricing, and availability accurately. However:

  • product colors/appearance may vary by device/screen

  • product details and availability may change without notice

  • errors may occur (including pricing errors, typos, and stock issues)

We reserve the right to correct errors and update information at any time.

5) Orders, Pricing & Payment

Order Acceptance

Placing an order is an offer to purchase. We may accept, reject, or cancel any order for reasons including:

  • inventory availability

  • pricing or listing errors

  • suspected fraud or unauthorized transactions

  • shipping limitations

If we cancel an order after payment, we will issue a refund to the original payment method.

Currency, Taxes & Charges

Prices are shown in CAD unless stated otherwise. Taxes and shipping fees (if applicable) are calculated at checkout.

Payment Methods

We accept payment methods displayed at checkout (including major credit cards). Payments are processed through third-party payment processors. FitVents does not store full credit card numbers.

6) Shipping & Delivery (Canada + United States)

We ship within Canada and to the United States. Shipping options, costs, and estimated delivery timelines are shown at checkout and/or in our FAQ. Delivery estimates are not guarantees.

Address Accuracy

You are responsible for providing a complete and accurate shipping address. Additional shipping fees may apply if an order is returned or reshipped due to an incorrect address or failed delivery attempt.

U.S. Orders: Duties, Taxes, Customs

For shipments to the United States, your order may be subject to customs processing, duties, taxes, or brokerage fees depending on destination and carrier rules. Unless we explicitly state otherwise at checkout, these charges are the customer’s responsibility.

Risk of Loss

Risk of loss transfers to you when the order is delivered to the carrier, except where prohibited by applicable law.

7) Returns & Refunds

Returns, exchanges, and refunds are governed by our Return Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Return Policy, the Return Policy controls for returns/refunds.

8) Promotions, Discount Codes & Pricing Adjustments

Discounts and promotional codes:

  • may be time-limited

  • may not be combined unless stated

  • may exclude certain products

  • have no cash value

We do not offer price adjustments for prior purchases unless required by law or explicitly stated.

9) Product Use, Installation & Safety Disclaimer

FitVents products must be used and installed according to any instructions provided with the product and/or on the Site. You are responsible for ensuring compatibility with your vent/register opening and for safe installation.

To the maximum extent permitted by law, FitVents is not responsible for damage or loss caused by improper installation, misuse, modification, or use outside intended purposes.

10) Intellectual Property

All content on the Site, including text, images, videos, logos, designs, and product names (collectively, “Content”), is owned by or licensed to FitVents and protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit the Content without our prior written consent.

11) User Content (Reviews, Photos, Comments)

If you submit reviews, comments, photos, videos, or other content (“User Content”), you grant FitVents a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, display, distribute, and create derivative works from that User Content for business purposes (including marketing), unless prohibited by law.

You represent that:

  • you own or have permission to share the User Content

  • it does not infringe others’ rights

  • it is not unlawful, abusive, or misleading

We may remove User Content at our discretion.

12) Third-Party Services & Links

The Site may contain links to third-party websites or services (including payment providers and shipping carriers). We are not responsible for third-party content, policies, or practices. Use them at your own risk.

13) Disclaimers

The Site and products are provided “as is” and “as available,” to the maximum extent permitted by law.

We do not guarantee that:

  • the Site will be uninterrupted, error-free, or secure

  • product descriptions will be fully error-free

  • results from using products will meet every individual expectation

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14) Limitation of Liability

To the maximum extent permitted by law, FitVents and its owners, directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, or loss of data) arising from or related to your use of the Site or purchase/use of products.

Where limitations are allowed, FitVents’ total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

15) Indemnification

You agree to indemnify and hold harmless FitVents from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

  • your misuse of the Site

  • your violation of these Terms

  • your infringement of any third-party rights

  • your User Content

16) Privacy

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and share information.

17) Changes to the Site or Terms

We may update these Terms from time to time. The “Effective Date” indicates the latest revision. Your continued use of the Site after changes means you accept the updated Terms.

We may modify, suspend, or discontinue any part of the Site at any time.

18) Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that any disputes will be brought in the courts located in British Columbia, Canada, unless prohibited by applicable law.

19) Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

20) Entire Agreement

These Terms and the Policies constitute the entire agreement between you and FitVents regarding your use of the Site and supersede any prior agreements or understandings.

21) Electronic Communications

By using the Site or contacting us electronically, you consent to receive communications electronically and agree that such communications satisfy any legal requirement that they be in writing.
